Con el objetivo de frenar prácticas como renunciar al trabajo, aparentar menores ingresos o simular deudas para evadir el pago de la pensión alimenticia, el diputado José María Alejandro Pérez Ramírez presentó una iniciativa para reformar la Ley para la Familia del Estado de Hidalgo.
La propuesta plantea modificar la fracción V del artículo 243 para ampliar las causales de suspensión de la patria potestad cuando la persona deudora alimentaria realice acciones para eludir su responsabilidad económica, como reducir artificialmente sus ingresos, ocultar percepciones extraordinarias o proporcionar información falsa sobre su capacidad económica.
El legislador señaló que el derecho a recibir alimentos es una obligación constitucional reconocida en el artículo cuarto de la Constitución federal, así como en la legislación estatal, donde se establece que los alimentos comprenden todo lo necesario para el sustento de los hijos, incluyendo alimentación, vivienda, salud, educación, vestido y recreación.
Explicó que, tras una separación o divorcio, el monto de la pensión alimenticia es determinado por una persona juzgadora con base en las necesidades de los menores y los ingresos de quien debe cubrirla. Sin embargo, en la práctica, muchos padres falsean información o modifican su situación laboral para aparentar una menor capacidad económica.
Entre las estrategias más comunes para evadir el pago se encuentran la falsificación de ingresos, el cambio de bienes a nombre de terceros, la simulación de un estilo de vida austero o incluso la renuncia al empleo para argumentar falta de recursos.
El proyecto advierte que esta situación constituye una forma de violencia económica que afecta principalmente a las madres, así como a niñas, niños y adolescentes, quienes dependen de estos recursos para su bienestar y desarrollo integral.
De acuerdo con datos del Instituto Nacional de Estadística y Geografía (Inegi), en México tres de cada cuatro hijos de padres separados no reciben pensión alimenticia, mientras que 67.5 por ciento de las madres solteras no cuentan con este apoyo económico.
La enmienda busca fortalecer el marco jurídico para evitar simulaciones y garantizar que las y los menores reciban los recursos que les corresponden por ley, señaló el asambleísta.
